This paper submits to critical analysis both the argument used to justify the traditional approach to the study of the Supreme Court ́s production and its retort. Next, the paper presents the texts that conform “The Genaro Carrió Court”. It concludes that, while each text is independent, they share a common argumentative line centered on the historical moment in which the court has to act as well as the concern to lay the foundations of a culture of argument for a democratic society.
