Abstract

In light of Núñez Vaquero’s paper, this one intends to clarify the insufficiency of summaries (“súmulas”) or theses for the identification of ratio decidendi. It also presents plurality decisions, born in American law, to demonstrate the importance of determining the argument shared by the majority of judges on the panel. It concludes that, without individual justification for each argument adopted by judges, there is no way to identify the ratio decidendi of their decision.
