Is It A Good Idea to Summarize Precedents and Case-Law? Introductory Notes to the Discussion

Abstract

This article aims to present the main points of the discussion on the paper “On Summarizing Case-Law and Precedent” by Álvaro Núñez Vaquero made by Sandra Gómora, Luiz Guilherme Marinoni, and Luca Passanante. To do this, we will start by reconstructing the author’s theses; then we will briefly present the criticisms made to them by the commenta- tors, as well as the author’s responses; and finally, we will formulate some possible problems on which to continue discussing.
