Abstract

This short paper responds to the criticisms of my article “When Experts Made the Law” raised by Juan Iosa, Francesca Poggi and Florencia Rimoldi. In particular, the paper examines whether the opacity of law is an epistemic or a semantic problem, defends the idea that the opacity of an authoritative text such a statute or regulation cannot be equated with the opacity of legal norms, and elaborates on the legitimacy of opaque authoritative texts in the context of technocratic legal regimes.
